1. Agreement and eligibility
By creating an account, accepting an invitation, using the services, or completing a purchase, you agree to these Terms, the Privacy Policy, and the Refund Policy. If you do not agree, do not use the services.
You represent that you are legally able to enter this agreement and are not barred from using the services. Organizations and server operators are responsible for everyone acting through their accounts or credentials.
2. Accounts and security
Provide accurate account information, keep credentials confidential, and promptly report suspected compromise. You are responsible for activity conducted through your account unless caused by QuibCo’s failure to use reasonable security measures.
Accounts and invitations may not be sold, transferred, shared publicly, or used to evade a suspension or capacity limit.
3. Closed-alpha services
Alpha features may be incomplete, unstable, reset, rebalanced, replaced, or discontinued. QuibCo may schedule maintenance, limit concurrency, roll back corrupted state, or remove experimental data when reasonably necessary for security, reliability, testing, or legal compliance.
Availability is not guaranteed. Dedicated-server capacity, multiplayer slots, generation workloads, storage, bandwidth, and other hosted resources are subject to the limits shown for the applicable plan or purchase.
4. Subscriptions and automatic renewal
Paid subscriptions renew automatically at the disclosed interval until canceled. Before purchase, Checkout will show the price, billing period, included entitlements, and applicable limits. You authorize recurring charges using your selected payment method.
You may cancel at any time. Unless a refund is required by the Refund Policy or applicable law, cancellation takes effect at the end of the current paid period and access remains available through that date.
QuibCo may change future pricing or plan benefits with advance notice appropriate to the change. A price increase applies no earlier than the next renewal after the stated notice period.
5. Credits and virtual items
Player credits, virtual currency, generated items, and in-game resources are limited licenses for use within the services. They are not deposits, stored value, property, or currency; have no cash value; and cannot be transferred or redeemed for money unless a separate written creator-payout agreement expressly provides otherwise.
Generation credits and hosted-resource allowances may be consumed when work is started or reserved. Refund eligibility is described in the Refund Policy.
6. Multiplayer and dedicated servers
Server operators must follow these Terms, enforce reasonable community rules, protect access credentials, and respond to safety and abuse reports. Operators may moderate their communities, but may not override QuibCo’s platform-level safety, security, entitlement, or content decisions.
Quotas may include concurrent users, compute time, storage, bandwidth, regions, build frequency, backups, and creator workloads. Attempts to bypass quotas, interfere with allocation, attack other systems, mine cryptocurrency, or run unrelated workloads are prohibited.
7. Acceptable conduct
You may not cheat; exploit vulnerabilities; harass or threaten others; impersonate another person; distribute malware; scrape protected services; disrupt infrastructure; infringe intellectual-property or privacy rights; facilitate fraud; or publish illegal, deceptive, hateful, sexually exploitative, or otherwise unsafe content.
Security research must avoid accessing other users’ information or disrupting service and must be reported through Support.
8. Creator content
You retain ownership of original content you create. You grant QuibCo a worldwide, nonexclusive, royalty-free license to host, reproduce, validate, modify for technical compatibility, display, perform, distribute, and make available your submitted packages as needed to operate, secure, moderate, promote, and improve the services. This license lasts while the content is submitted or published and for reasonable archival, backup, dispute, and safety purposes afterward.
You must have the rights needed for everything you submit. Creator packages may contain only supported declarative content and approved assets. Arbitrary executable code, concealed network behavior, credential collection, and attempts to escape package validation are prohibited.
Submissions may be scanned, quarantined, rejected, delisted, version-pinned, or removed. Accepted versions may remain available to preserve purchases, server compatibility, moderation evidence, and backups. Creator earnings and payouts remain disabled until governed by a separate creator agreement and payout policy.
9. QuibCo content and license
QuibCo and its licensors retain all rights in the services, game, software, brands, documentation, and content not supplied by users. Subject to these Terms, QuibCo grants you a limited, revocable, nonexclusive, nontransferable license to use the services for their intended purpose.
You may not extract assets or source code for redistribution, remove rights notices, sell access, or use the services to train a competing model or product except where applicable law expressly permits and does not allow restriction.
10. Enforcement and termination
QuibCo may warn, restrict, suspend, or terminate accounts, content, servers, or access when reasonably necessary to address abuse, fraud, cheating, security risk, payment failure, legal requirements, or material breach. Urgent action may occur without advance notice.
You may stop using the services and request account closure through Support. Subject to technical feasibility, law, security, and the rights of others, you may request an export of eligible account and creator data before closure. Transaction, fraud, moderation, backup, and legal records may be retained as described in the Privacy Policy.
11. Third-party services
The services rely on providers such as Stripe and Amazon Web Services. Their services and terms may apply to features they provide. QuibCo is not responsible for third-party services outside its reasonable control.
12. Disclaimers
To the fullest extent permitted by law, the services are provided “as is” and “as available.” QuibCo disclaims implied warranties of merchantability, fitness for a particular purpose, noninfringement, and uninterrupted or error-free operation. Nothing in these Terms excludes warranties or remedies that cannot legally be excluded.
13. Limitation of liability
To the fullest extent permitted by law, QuibCo will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunity. QuibCo’s aggregate liability relating to the services will not exceed the greater of US $100 or the amount you paid QuibCo during the twelve months before the event giving rise to the claim.
These limitations do not apply where prohibited by law or to liability that cannot legally be limited.
14. Changes
QuibCo may update these Terms. Material changes will be identified by a new effective date and communicated through the service or account contact information when appropriate. Continued use after the effective date constitutes acceptance where permitted by law.
15. Governing law and contact
California law governs these Terms, without regard to conflict-of-law rules, except where consumer law requires otherwise. Any court proceeding must be brought in a court with jurisdiction over QuibCo’s principal place of business in California, unless applicable law gives you another right.
